DECISION GUIDE / AI models
Does permission to use a still model photo cover an AI-generated video derivative?
Permission to use a real model's still photograph does not automatically cover an AI-generated moving or speaking version of that person. Before uploading the reference for video creation, review the actual signed terms for permitted media, synthetic alteration, territory, duration, and identity portrayal. Ask the responsible rights holder to approve the proposed derivative use or keep the project on hold.
Define the new use before uploading the photo
A still catalog photograph and a generated talking advertisement are different creative uses. The second may introduce motion, speech, facial expressions, and implied personal participation not present in the original photograph.
Fictional exercise: a real adult model authorized a still-image catalog campaign. The seller now proposes generating a video in which the model appears to speak positively about the product. The exercise provides no authorization for synthetic animation or endorsement.
This decision occurs before creating a derivative. It differs from responding to a later withdrawal request, when existing assets and publications already require review.
Prepare a use-specific permission intake
Ask the authorized rights reviewer to inspect the actual agreement. Separate the original still-photo permission from the proposed video medium, synthetic identity alteration, intended territory, duration, and portrayal.
Adobe Stock's release guidance is an example of documentation practice, not universal permission for AI derivatives. Only the actual applicable terms can establish the recorded scope.
| Permission dimension | Fictional record | Proposed video use | Decision |
|---|---|---|---|
| Medium | Still catalog | Moving advertisement | Review |
| Synthetic alteration | Not specified | Animated face and speech | Hold |
| Territory and duration | Actual scope not supplied | New campaign distribution | Unresolved |
| Identity portrayal | Catalog modelling | Spoken product endorsement | Do not infer permission |
Resolve the derivative scope before production
Prepare a concise description of what the generated person would do, say, and appear to endorse. Include intended publication channels and the proposed campaign period. Send that description to the responsible rights holder rather than requesting a vague approval for 'AI use.'
If the approved scope does not cover the proposed use, do not upload the still photograph to create that derivative. Consider a separately authorized reference or a suitable fictional character without reproducing the real person's identity.
Itemlume can create visual concepts but does not obtain model permissions or certify identity rights. Text planning is free after sign-in; image and video generation follow current quoted prices.
- Identify the exact adult model photograph and agreement.
- Describe the proposed motion, speech, and identity portrayal.
- Record intended media, territories, duration, and recipients.
- Ask the authorized rights holder to review the actual terms.
- Mark permission approved, restricted, or unresolved according to the real decision.
- Begin derivative production only within the confirmed scope.
Review the final portrayal against the approval
Permission for one defined animation does not automatically authorize new spoken claims or another campaign. Compare the finished video with the description actually reviewed, including expression, narration, captions, and implied endorsement.
Any subtitles or audio finishing must be completed externally; Itemlume does not provide automatic subtitle production or editable video-project export.
Keep the permission record, approved use description, responsible reviewer, final asset identifier, and publication destinations together. If the scope cannot be established, hold the derivative. This intake does not establish a jurisdiction-wide legal conclusion.
Record the decision in a manual worksheet

Frequently asked questions
Can I animate a model's face because I have permission to publish the original photo?
Not automatically. The actual agreement must be reviewed for synthetic alteration and the proposed video use.
Does permission for AI animation also permit making the model speak an endorsement?
Do not assume so. Speech and endorsement portrayal require review of the actual authorized scope.
